How to File a DBA in Florida

Florida uses the term “Fictitious Name Registration” for what many business owners call a DBA. The basic process involves choosing the name, identifying the owner, satisfying the publication requirement and submitting the registration.

Step 1: Decide who owns the DBA

Determine whether the registrant is an individual or an established business entity. If a business entity owns the fictitious name, an authorized individual signs on behalf of that business.

Step 2: Choose and investigate the name

Search Florida public records and consider whether the name could conflict with another party’s rights. A state fictitious-name filing is not a trademark clearance.

Step 3: Meet the publication requirement

Florida states that the name must be advertised at least once in a newspaper located within the county where the principal place of business is located. The applicant certifies this requirement; proof of advertisement is not required to be submitted with the registration.

Step 4: Submit the registration

The current Florida state fee for a fictitious-name registration is $50. Online filing is available through the Florida Division of Corporations.

Step 5: Keep the registration current

Florida states that fictitious-name registrations are valid for five years and expire on December 31 of the final year. A renewal is required to continue the registration.
