Who can create a DBA
Individuals and sole proprietors
If you do business under any name other than your own legal name, Florida requires you to register it. "Maria Lopez" selling as "Coastal Candle Co." is a common example.
Existing businesses
An LLC, corporation or partnership that operates under a name different from its registered legal name registers that name as a fictitious name. Each extra brand name gets its own registration.

Questions
Is a DBA the same as a fictitious name in Florida?
Yes. Florida's legal term is fictitious name. DBA, short for doing business as, is the everyday term for the same registration, which is filed with the Florida Division of Corporations under section 865.09, Florida Statutes.
What does the fee include?
The $50 Florida registration fee, the required newspaper notice in your county, preparation of your application, filing with the Division of Corporations and a copy of the state's acknowledgment with your registration number.
Do I need a DBA if I already have an LLC?
Only if the LLC does business under a name other than its exact registered name. For example, Sunshine Pools LLC operating as Gulf Coast Pool Care would register Gulf Coast Pool Care as a fictitious name.
How long does a Florida DBA last?
Five years. A registration expires on December 31 of the fifth year. You can renew it between July 1 and December 31 of that year for $50.
Does a DBA protect my business name?
No. Florida registration is for public notice only. It does not reserve the name, and more than one person or business can register the same fictitious name. If you need to protect a name, look into a trademark.
Is FLDBA.com part of the State of Florida?
No. FLDBA.com is a private filing service and is not affiliated with the Florida Department of State or Sunbiz. You can file directly with the state yourself for $50 plus the cost of your newspaper notice.
